I went to Harbor Freight yesterday and the engine stand I needed for today was on display and the only one they had in the entire store. I am 35 miles one way from the store and in upstate NY. The last I knew the law said if I wanted the display they had to sell it to me they claim that is not so. Did the law change or not and if so when? Thank you Sue
Optional Information: State/Country relating to question: New York Already Tried: We did force them to give us the display I just want to know who is correct
I have never heard of that law and can't find it.Are you sure it was a law or was it just something you heard?
Would it be business law? They are advertisiong they have the items then they only have the display it should be for sale or not? Oneida County NY I am not the only person who understood this was a practice and a law
There was some old law regarding bait and switch where they advertise items for sale prices but then don't stock them but that is a tough case to make because their policy may very well be "we don't sell displays for liability reasons", which I've heard companies say before. There is no statute that says they have to sell display items and no case law either. I suspect that this is one of those urban myths, like the 3 day right to cancel a contract, that had some basis in fact but is not as inclusive as people believe.Thank you for allowing me to assist you. Shouldn't they have to dispaly a sign to indicate they don't sell the displays?
As strange as it seems there is absolutely no requirement in any state that they do that. In addition, courts now are notoriously business friendly and so your chances of success at changing the law are almost nonexistent.Thank you for allowing me to assist you.
