There are several things that an employer can do to thwart a lawsuit for wrongful discharge before it starts.

An employer should document everything that happens with an employee, listing any facts that might be necessary after termination. If the employee is late, document it. If the employee has a bad attitude, document the circumstances. On each occasion, write down the details and let the employee read and sign the documentation. It might be something as simple as repeated absences due to children being sick, but document it.

If an employee has repeated absences, be sure to require that said employee brings a doctor's note, court note or other note stating the reason that they are not present. If there is no reason, document that the absence was unexcused. This will leave no room for doubt if the employee is fired for having repeated absences.

An employer can also set up an anonymous "drop box" so that employees can voice their concerns anonymously. By doing so, an employer can stop a potential problem before it starts. Small things like dirty bathrooms and overcrowded cafeterias can be cause for concern with many people, rather than just one.

There are many things that an employer can do to thwart a lawsuit before it starts.

In most States, all employees are considered "at will" employees - that means that the employer can terminate the employment relationship, "at will"
