An ex-partner of mine, who is MIA right now, had withdrawn

An ex-partner of mine, who is MIA right now, had withdrawn $19,000 six months ago out of the business account I'm part of - told me that it was for hospital expenses, but I found out that this ex-partner had purchased a house with this money.
I have documentation to show that I'm a partner in the company. However, I haven't had any authority over the bank accounts. Is this considered theft? Would this be a civil case or a criminal case? This happened in Aurora, Colorado.
