I have moved into a new subdivision and my neighbour did not

Customer Question

I have moved into a new subdivision and my neighbour did not want to split the cost of the fence between us. I made sure I put it up on my property ... now he wants to butt his perpendicular fence up to it and in fact he is now on 6" of my property..... sounds petty but its $1600 worth of petty out of my pocket .... can I make him move his post or pay up?

He has no right to put his fence over the property line. It is trespassing. He has to move his fence off your property.

He has no intention of moving it .. Already spoke. Do I need to get a Sheriff or Bylaw to help?

You can try but if no one will help you should have a lawyer threaten a lawsuit and if that doesn't work you will need a court order.
