We purchased a lot in a subdivision and are having a small home built similar to all of the other homes in this area. An amendment was passed by the planning committee to allow for ten two story rental units to be built right across the street from us. Now there is another application for amendment to build two more beside the new home we are building. This will destroy the ambiance of the community and allow too many vehicles in a short***** How can I fight this? Can it be defeated?

If the committee is afraid of a lawsuit then it would be best to have a lawyer send them a letter making it clear in implicit terms that if you lose they will also have a lawsuit.

And that the grounds for the lawsuit will be that they failed to exercise their discretion properly and failed to apply the by-laws and the purpose of those by-laws properly.
