Customer Question

ATTN: DEBRA THAL
Re: other side's request and another adjournment.

1. August 20 : EMAIL FROM ME TO OTHER SIDE: I sent a scanned copy of a NOM to other side. Appearance for court is Sept.9
2. August 21 : EMAIL FROM OTHER SIDE TO ME : the lawyer sent me a scanned letter saying in effect, "...correspond in writing only...we will not respond to any communication not provided in writing...."
3. Sept. 3 : EMAIL FROM OTHER SIDE TO ME : "you've not given us 7 days notice for the trial...according to court rules...we will adjourn this court appearance on Sept 9...."

Q: Does a Notice Of Motion have to be presented in person only? and by a 3rd party?
Q: I've sent a Notice of Motion by Registered mail; is this ok?
Q: What about this craziness of her saying to me IN AN EMAIL, and AFTER THE FACT, "you must correspond in writing only...."

Please prep me for a "side fight" on this issue.

I notice that the Lawyer has a technique of attempting to tie me up fighting HER DIRECTLY on insane issues to wear distract me. How can I MITIGATE THIS?

This is not an originating document so personal service is not allowed.

But you cannot serve by way of email without her consent.

You can serve by fax.

Serving by Registered Mail is fine.

I wonder if she wanted to pretend she didn't get your email? Totally crazy!

Why not ignore all this nonsense such as that email and continue as if she never wrote you?

I asked registry. Court still on Monday. No adjournment today so far.....

I like how this lawyer is so strangely like my wife was...bizarre liar, crazy, nonsensical behaviors.
Good for my case though.
Thanks Deb.
I've now gotten hold of the transcript from the courts.
I'll b asking you, if you're into it, about a "defamatory statement" lawsuit now....

The journey continues.
