My fiance owns a house with her dad. We will be living in that house after we are married. I will be making the mortgage payments for that house. My fiance has given me a pre-marriege contract stating this house will not be part of the marital assets and that I am not entitled to get back my mortgage payment monies if we decide to split. Is this type of pre-marriage contract legal?

This is a marriage contract and it's legal. You do not have to agree with it of course. And for sure you need your own lawyer to review it before you sign it.I hope that has happened. If not let me know and I can suggest ways of finding a lawyer.
