Yesterday I was charged with assault.. I am 64 yr old women- good education and excellent community relations. Never been to court before for myself. I was babysitting my daughters children, getting ready for the little one's B-party. My daughter Renee, is the mother of 4 children 16-6. She has kicked her husband of 15 years out 6 months ago. My disabled son was leaving the property when David picked him up and threw him out the door. I came down as told them to stop. And my son left. David then told me I was not allow in his house. I laughed andturned to go inside to finish the B-party preps. Hegrabbed me and pushed me out of his way - I fell backwards off the stoop. I jumped back up and his fists were up so I went for his face and scratched him. He called the police and I was chargedwith assault. Dr. at hosp. said bruising on my chest was consistent with push.

Hosp; Dr. has provided chart for police. Now the a day has gone by I am now bruise in the chest and my arm is very sore. I am 64 and 5'2 tall, David is 6'2" and a construction worker. He was yelling in my face- that is how I reached his face.

It was my daughter Renee's house but Dave is still on the mortage although he has his own rented accommodation.
I would like an answer to my question. Can I be charged with assault when I was protecting my self?? Police will not listen and have gone ahead with charge. I said I wanted to charge his with assault and they said not evidence?? I asked what evidence they had and was told to wait until court.
