How long should it take to settle and estate in Canada, and how soon after the death should the will be filed?
What province did the deceased live in please?

Have you asked the executor what's going on?

I've sent email but she hasn't reponded.

The lawyer cannot respond to you as the lawyer acts for the estate and not for you. It would be a breach of the lawyer's duty of confidentiality.

In Ontario all beneficiaries must be provided with the application for probate and this will have a copy of the Will attached to it.

It takes several months for this to happen in most cases and things go very slowly in the summer since people are all on vacation at different times.

So, 3.5 months is not at all out of the ordinary in the scheme of things and it may be that nothing happens until the Fall.
