Is it legal to buy a crossbow in Canada

Customer Question

Is it legal to buy a crossbow in Canada?

Optional Information

New Westminster, Canada

Already Tried:
I tried to purchase a crossbow online, but the item was arrested by CBSA (Canada Border Services Agency) with reference to Prohibited Weapons Regulations (SOR/98-462). Before I made a purchase I checked legality of crossbows in Canada online: http://en.wikipedia.org/wiki/Laws_on_crossbows "In Canada, it is legal to own a crossbow and has a similar designation as an airgun. No licence is required to purchase a crossbow." Now I'm confused: Is it legal to buy a crossbow in Canada in reality? And what should I do about my arrested (by CBSA) purchase?

Expert's Answer

Certain types of crossbows are legal in Canada. Some provinces restrict their use especially with respect to the hunting of wild life.

Could you please be more precise with your answear: What types of crossbows are legal in Canada?

To buy and own a crossbow is not the same thing as "the hunting of wild life".

Is Wikipedia lying or not in the statement: "In Canada, it is legal to own a crossbow and has a similar designation as an airgun. No licence is required to purchase a crossbow"?

Expert's Answer

I apologize for the brief post above. When I answered your post I wasn't able to see the "already tried" additional information. That's why I was waiting for your particular information.

Wilipedia can never be relied upon. It's not even considered to be an acceptable site for high school kids to use. It's not lying. It's providing some general and overly simplistic information for general knowledge purposes only.

Flagbridge, who is a well regarded, experienced expert on this site, advises me that the crossbow, provided it is not over 500mm in length, is a RESTRICTED firearm under section 84(1) of the Criminal Code. Therefore it is not prohibited. However to import you are required to have a Registration certificate.

I hope that answer now answers your question and I do apologize again.

How can possibly a crossbow be considered as a firearm? You must be kidding me, right? Why don't you call it a nuclear weapon of mass destruction?

Expert's Answer

I don't make the laws and I know nothing at all about crossbows so I can't really offer an educated opinion.

Dear XXXXX,

Crossbows are the subject of my question. If you "know nothing at all about crossbows" then why did you even bother to answear it?

Definitions are the foundation of any logic and laws. The word "firearm" has its very specific meaning and it has nothing to do with the word "crossbow". Please check it in your favorite dictionary.

Hello,

I am sorry for the confusion thus far.

Under Canadian Law, (The criminal code to be exact, section 84.1), a crossbow is called a restrictive firearm, as 84.1 specifically references Schedule 3 which describes a crossbow as

7. A crossbow or similar device that

(a) is designed or altered to be aimed and fired by the action of one hand, whether or not it has been redesigned or subsequently altered to be aimed and fired by the action of both hands; or

(b) has a length not exceeding 500 mm.

The term firearm and weapon is used interchangibly when it comes to restricted weapons of a projectile nature.

Specifically (SOR/98-462) makes it clear that a crossbow is a weapon under the Canadian Criminal Code 84.1

To top it off under CBSA BSF5044, crossbows are PROHIBITED from entering Canada. that does not mean you can not buy one and license one made in Canada. You can not IMPORT them.
