  • My sister and I are joint powers of attorney for my 88 year

    My sister and I are joint powers of attorney for my 88 year old Mom who has advanced Alzheimer's. This has been determined by doctors, however, to capacity assessment has been done.

    Right now Mom has a bank account where I am joint. That happened in 2011. My sister, my Mom and I went into the bank to have the three of us put on the bank account with anyone to sign. However neither my sister nor I had proof of SIN# XXXXX couldn't be added that day. I provided mine and was added. My sister never did and was not. Since that day BMO has lost all of the paperwork.

    My sister and my Mom went to BMO with the purpose of getting sister added to the account. The bank recognized that Mom was unable to make her own decisions and refused to add my sister. They also won't let me have my sister added since it is Mom's money and her account. BMO said that the only way for sister to be added to the account was for a medical assessment to be done and then as joint powers of attorney we could do that.

    Now my sister wants me to write a cheque on Mom's bank account withdrawing the money and depositing it in a joint account to be opened that would be owned by my sister and I and not Mom.

    Is this legal?

    The mother of my two kids filed for child support, and now wishes to settle out of court. To cancel the process, she was told of a form that she will have to fill out, and both of us sign... She was told we will both have to still go in for the first court date.. Does this process sound correct ? Any advice for my situation would greatly be appreciated. I want to make sure I am prepared and everything runs smoothly.

    I have a legal adoption of a 3 year old with a partner of 4 years. I have been the primary care giver as a stay at home mom and my partner has been the provider working full time. The relationship is in seperation mode and I need to get out however she is saying she is not paying me out for the house or alimony and in fact claims she wants our child 50/50 now so she wont have to pay child support. I feel completely trapped as I currently have no income and sold my house and gave up my career to be here and she makes over $200,000 a year. She has said she is in the financial situation to fight me for our child. She has also said because I am the one who wants out she isn't responsible for paying out anything. So If I leave with him what kind of action could she take in regards XXXXX XXXXX child? What rights do I have to the house (there is aprox $150,000 equity and I am on title) and assets? If i walk out of here do I give up rights to the house and open myself up to be seeing as unfit as a parent?
