what is the difference between a motion and a trial?
Already Tried: 1st try
A motion is usually where issues are decided on an interim basis rather than a final basis.
And most of the time the Judge relies on Affidavit evidence rather than live testimony.
There are not witnesses and usually if the parties have lawyers only lawyers attend the motion.
