I submitted my claims for my FSA health care one day late.

Customer Question

Hi, I submitted my claims for my FSA health care one day late. My claims have now been denied and it looks like I will have to forfeit the money in the account now.
JA: Because laws vary from state to state, could you tell me what state is this in?
Customer: CA
JA: Have you talked to a lawyer yet?
Customer: No, I have not
JA: Anything else you think the lawyer should know?
Customer: The claims were relevant for the year that I was filing for. It's just that I was one day late

Unfortunately I know of no legal basis to extend the deadline if you missed it unless your employer's plan allows for some type of grace period. Also, you may want to check the plan and see if there is a way for you to carry over money left in the account to this year.

I know this is not the answer you wanted to hear, but I am assuming that you are wanting a professional and honest answer.
