Is it lethal for an attorney of a complainant to fail to timely serve a copy of the DFEH complaint on the employer per Govt.C. 12962?

Since it violates the statute, failing to timely serve a compy of the DFEH complaint on the employer could cause the case to be dismissed for failure to timely serve a copy of the complaint on the employer.
