What type of test are you referring to? Have you been on FMLA leave or another type of protected leave or just disability due to anxiety?

its fmla been out for 3 months no prior drug or work related incidents

Thanks for the additional information.

If your employer does not regularly drug test employees, there would be no reason to believe that your employer would drug test you since you have no prior drug issues or work related incidents.

However, as an at-will employee, your employer can require you to submit to a drug test at any time for any reason (due to the diminished expectation of privacy in the workplace) so it is a possibility (albeit a very small one) that your employer would drug test you when you return to the work force.
