My ex boss has sent me an email threatening to sue me because when I filed for unemployment (I quit) I wrote down that his company was being investigated for fraud by the california health department. I had reason to believe this was true because they audited the office while I was there and overheard discussions regarding an investigation. I live in california. He still owes me for back wages also.

As long as what you wrote was your opinion, then your ex-employer wouldn't have a valid case against you for defamation. Additionally, it would be very difficult for your employer to prove damages from your statements made to EDD.

If you are owed for back wages, you should file a wage claim with the Department of Industrial Relations.
