I am on written warning at work. I received an e-mail inquiring if anyone was interested in a new position being created and that they would consider someone in my Salary Grade who might be struggling. I inquired and was told I could not be considered for the position due to the written warning.

They are asking for people who are struggling and I am clearly struggling, yet i can't apply because of the warning. Is this standard with companies/? I just didn't like receiving an e-mail saying they are looking for people struggling in their position and that they would consider someone struggling as it would be a Step down.

Yes, unfortunately, this is pretty standard with companies, and you wouldn't have any legal recourse against the company for failing to consider you for the position due to the written warning.
