Customer Question

Is an independent contractor in the state of Florida held to a noncompete contract? My friend runs a chiropractic office and has since left. All of the billing has been run through his license and he was paid as an independent contractor so the owner could avoid payroll taxes.

Thank you for your question. Please permit me to assist you with your concerns.
Florida generally upholds non-competes so long as the agreement was signed and agreed upon by the parties and is not seen as being overly restrictive (it does not have a large geographical, time, or specialization limitation).
Sincerely,
Dimitry, Esq.
