A contractor got a judgment against me because I did not show. I only received 7 days notice. (show I have received more time?) I was going to pay him before he even filed the suit (keep in mind the job at this time he has only waited one week) he told me I'm gonna file suit for refusal to pay and said I'm not refusing I'll pay you next week. Apparently that was not good enough for him so he went ahead and filed suit. Now that he has the judgment he's acting like a asshole, harassing me and threatening me. I own a restaurant and last night he sent me a text me saying did you hear about the restaurant in Conn. 1000 white mice ran through the dining room friday night and the place had to close for weeks! I asked him how this applies to me? Just because I'm not allowed in your restaurant doesn't mean I can't invite some of my close friends to enjoy a wonderful dining experience and they can bring lots of their friends with them. You don't have to be a rocket scientist to figure out what he is saying. This guy is a lose cannon with mental issue and I fear that he might try something like this. Should I file a complain of a Terroristic Threat with the police department...what would you say in a case like this. What can I have done about this guy.
Optional Information: State/Country relating to question: New Jersey Already Tried: nothing yet
Yes, I'd call the police even though they are likely to tell you that there is nothing they can do.You can hire a lawyer and apply for an injunction against him but realistically that isn't going to do much good if his "friends" do something and you can't prove he directed them to do it.You will also want the lawyer to look into the judgment. You should have had more than seven days notice between the time he filed the suit and it was set for trial if it was a suit for damages. If you would like any additional information or have more questions please don’t hesitate to ask but please do so my clicking on the Reply to Expert tab.We work for Positive Ratings, please click on one of the top three ratings or one of the Smile Faces, as this would be appreciated. This is not take my time get a lawyer and wait...this guy is a time bomb ticking and I fear for what he might do. In new jersey a person is guilty of a third degree if he threatens to commit any crime of violence with the purpose to terrorize another or to cause evacuation of a building, place of assembly, or facility of public transportation, or otherwise to cause serious public inconvenience, or in reckless disregard of the risk of causing such terror or inconvenience.
My experience has been that the police normally don't respond to something like this but I think you should make the complaint anyway, as I said above. That way there is a record of what he said.If you would like any additional information or have more questions please don’t hesitate to ask but please do so my clicking on the Reply to Expert tab.We work for Positive Ratings, please click on one of the top three ratings or one of the Smile Faces, as this would be appreciated.
