Law Girl :

Thank you for your question. Is the fee in the contract? Is the fee for being late with payment or for picking up a child late?

Customer:

Being late with payment.

Customer:

I don't believe it is stated anywhere on the contract I signed that a fee would be applied weekly.

Law Girl :

The daycare has the ability to charge a late fee; however, each client needs to be made aware of the charging of a late fee. This is generally laid out in the contract or a later amendment thereto.

Customer:

okay is it legal to charge their fee weekly? most places have a monthly charge....

Law Girl :

Yes, they can charge their fee however they see fit. That is left to their discretion.

Customer:

okay...does a business have to attempt to make contact with someone both written and by phone before turning them over to a collection agency?

Law Girl :

No. It is a good business practice but is not required under law.
