Can a night club sue a club promoter for libel where said promoter

Resolved Question:

Can a night club sue a club promoter for libel where said promoter posted certain remarks about the club on his wall (that they serve minors alcohol, allow underage women to get into the club, etc.), visible only to his friends, for a total of 2 hours? The night club is suing for $20,000 in damges.

Thank you for your question.

Yes, a night club can sue. Here is why:

To prove defamation the victim must show 4 factors to prevail:

1. That a defamatory statement was made
2. Of or concerning the victim
3. To third parties
4. Which caused damages to the victim.

Even "friends" on facebook are deemed third parties. Therefore the only factor that would be tough to prove are damages--which they are alleging to be $20,000.

Hope that helps.
