I have a lawyer that insists the retainer I paid was earned

I have a lawyer that insists the retainer I paid was "earned when received" and says there is no refund due, even tho his billing statements reflect a substantial balance. Is this normal?

What your attorney is telling you is complete bunk--if he did not perform the work, he MUST return the retainer. If he refuses, contact your local bar association, file a formal grievance, get them to investigate, and then file a malpractice suit against the attorney for damages and for breach of his ethical duties.
