TIME SHARE IN PUERTO
VALLARTA, MEXICO AND THEY ARE ASKING
ME TO PAY A VAT TAX ON MY
MAINTENANCE BILL. ITS MY
UNDERSTANDING THAT MY MAINTENANCE FEES ARE
FOR THEIR EMPLOYEES SALARIES
AND REPLACEMENT COSTS OF
FURNITURE,APPLIANCES AND
UPKEEP. THEY SAID IN AN
EMAIL THAT THIS IS A SALES
TAX UNDER MEXICAN LAW. I HAVE BEEN AN OWNER SINCE 1986 AND HAVE NEVER SEEN THIS ADDED TAX. IT DOESN'T SEEM RIGHT TO ALL OF A SUDDEN ADD THIS TAX TO MY BILL. ANY

Mexico definitely has a VAT tax. And it applies to these maintenance fees.

 

So either they were not collecting it when they should have been, or they were absorbing the cost themselves in previous years (which is legal).

 

So you need to look at your purchase and maintenance agreement(s) to see if they have assumed the VAT liabilities in a binding way, or whether they simply were not collecting them before...

 

Ultimately, if they are in breach of their contract, you can sue to enforce in a Mexican Court.
