First the lights on the hatch went on and drained the batteri. Then the upper hatch/tailgate would not close. I took the lights out so the batteri did not drain. The lower hatch works fine.

hi,
you didn't select a high urgency question so it can take time to get an answer.
I will provide an honest answer. I trust this will be appreciated. Please remember that a low rating PUNISHES me for being honest and that I receive nothing for my time until a positive rating is clicked.
the most likely cause is a simple failure of the latch mechanism itself.
this is not terribly common but does happen.
the other possibility is that the latch is out of sync or there is a wiring issue to it. most likely a simple failure, though
Please let me know if you have further questions. Please do not forget to click a positive rating as this is the only way I receive credit for my answer, thank you. Best wishes with your vehicle.
