If a 401K is closed out within 6 months of filing for bankruptcy, does the money become part of CMI on a means test?
Over 34 years, I have assisted my clients with debt problems having filed more than 32000 Chapter 7 and Chapter 13 Bankruptcy petitions.

NO it does not have to be scheduled on the means test. However, on the petition, statement of affairs, you will need to document how the money was spent as the question asks: in the last two years have you sold, transferred, or given away.... As such, the 401k was liquidated. So as long as you can account for it, you will be fine.

If there is no court order for child support (but spouse pays some $), when filling out the bankruptcy papers, can the amount he pays be entered on Part V, # XXXXX , as a deduction from his income?

Yes so long as he has cancelled checks or other proof of payment.

Even without a court order or anything in writing?

Your original question was about a 401K liquidation. I will now opt out.
