This answer was rated:

If a debtor if married and wants to file a chapter 7 BK separately for her debt however the husband refuses to cooperate and wont supply his pay stubs etc is there a way for her to still file. They are not separated

Paul K, Esq. :

Hello, my name is XXXXX XXXXX I would love to assist you. Give me a moment to research your issue and I will answer promptly.

Paul K, Esq. :

Unfortunately not really.

Paul K, Esq. :

Unless they are separated, it is a requirement that the Debtor hsow total household income.

Paul K, Esq. :

So it is kind of a bummer when a spouse wont cooperate, but the court will require it.

Paul K, Esq. :

THe only way around it is if the husband gives his info on a piece of paper or something.

Paul K, Esq. :

Meaning, rather than giving his personal docs, he writes down the numbers for the wife.

Customer:

Thank you

Paul K, Esq. :

That way she can fill in what the numbers are without using his actual paperwork.
