Customer Question

I filed bankrupcy and had to put my house in it because of liens against it and it has been discharged since March 15 2012. The first lien holder wonts to refinance it back to us. I recieved a notice from the second lien holder saying they would reattach there lien on this house if I remaned or refinance this house. I was told that they could not do that after it was discharged. Can you please advise me on this matter....Thanks Randy

cfortunato :

Hi - my name is Chris and I'm a Bankruptcy attorney here to assist you.

cfortunato :

Did you file a Chapter 7 or a Chapter 13 Bankruptcy?

JACUSTOMER-omfbt2sm- : Chapter 7
cfortunato :

Thank you for your response.

cfortunato :

A Chapter 7 Bankruptcy can discharge your liability to pay the second mortgage, but cannot remove the lien.

cfortunato :

This means the second mortgage company can foreclose that house once the balance owed on the first mortgage is less than the market value of the house.

cfortunato :

Is this what you wanted to know.
