A friend paid an attorney the full amount for a simple Chapter

Customer Question

A friend paid an attorney the full amount for a simple Chapter 7 bankruptcy. And she has done all the law requires to get such relief. The problem is she has given her attorney as list of her creditors and the dates her accounts were closed in 2009. He said the problem is while she gave him the name, addresses and phone number of each such creditor, she has not provided him with the date she opened accounts with each creditor and the current outstanding balance on each account. She has called five of these creditors and they all refuse to provide her with this information. Of course they all say they would give it to him but not to her. Yet he still puts all of the responsible for getting this information on her. Pray tell how can she do this.

cfortunato :

Hi - my name is Chris and I'm a Bankruptcy attorney here to assist you.

cfortunato :

The dates and the amounts owed do not have to be exact. All this information can be approximate - and is approximate for most creditors.

cfortunato :

The Bankruptcy court does not expect debtors to list the exact information concerning the opening date and the balance owed.

cfortunato :

Your friend can provide the information that she can find on her credit report (this is where most Bankruptcy attorneys get their information from).

cfortunato :

She should get copies of each of the 3 major credit bureaus. She can get free copies at www.annualcreditreport.com.
