i am in an active chapter 13. I would like to sell my house, what steps would I have to take through the court if possible? I would be able to make a profit at this time.
Over 34 years, I have assisted my clients with debt problems having filed more than 32000 Chapter 7 and Chapter 13 Bankruptcy petitions. You must file a motion to sell and obtain approval from the court trustee. Likewise, all of your creditors have to be noticed. And you will have to attend a court hearing. Further, all profits become property of the court which will use the money to pay our other creditors.
