Will it hurt my case if I dont list everyone that stays in

This answer was rated:

Will it hurt my case if I don't list everyone that stays in my household when filing chapter 13? They don't contribute any money to the household.

cfortunato :

Hi - my name is XXXXX XXXXX I'm a Bankruptcy attorney here to assist you.

cfortunato :

The number of persons in your household helps to determine whether your Chapter 13 will last for 3 years or for 5 years.

Customer:

I understand but this person will be moving out soon.

cfortunato :

How soon?

Customer:

In two months

Customer:

or less

cfortunato :

Do you support this person at all (provide meals, or anything else)?

Customer:

no

cfortunato :

Then this person is not a part of your household, and you should not list him or her as a part of your household - even if he or she is living in the same house or apartment.

cfortunato :

Living in one's house is not the same as living in one's household.

Customer:

That's what I thought; thank you!

cfortunato :

You're welcome!
