Optional Information: Country relating to Question: United States State (if USA): North Dakota Already Tried: i haven't tried anything yet. but before the judgement was filed, i paid $1,000,00 to the funeral home and offered to send monthly payments to the collection agency. they refused. told me it would take to long to pay off
You certainly can file bankruptcy and avoid a judgment against you for an ordinary debt. Bankr. Code § 524(a)(1).You can also try to negotiate with the creditor, by simply telling them that unless they accept your offer, you will file bankruptcy and they will get nothing. Hope this helps.
