I filed bankruptcy on my own without an attorney last October

I filed bankruptcy on my own without an attorney last October and it was denied based on not being 8 years from the prior one. In June of this year, it will be eight years from my prior one. The trustee took my tax return in March and just last week, I received a portion of that back from the trustee, it said the debtors share of 2011 tax return. I kind of feel like I'm in limbo, do I need to refile for bankruptcy in June?

In what month was the first Bankruptcy filed?

It was filed I believe in April and discharged in June

Has your current Bankruptcy case been closed?

Not that I know of...

You do have to file another Bankruptcy in order to receive a discharge. You can file another Bankruptcy as soon as the current case is closed.

Customer:

Will they send me some information letting me know it is closed?

The 8 years is measured from the date last Bankruptcy that was discharged was filed (April), not discharged.

Yes - you will receive a notice in the mail as soon as your case is closed.

Customer:

How long does that normally take from the time of notice that it is denied?

cfortunato :

It should take no longer than a few weeks, but some trustees are very inefficient, and for them it can take a few months.
