I am currently a Florida resident, if I move to NY and change my residency to New York and then wait 91 days...can I file a Chapter 7 Bankruptcy using the Federal Rules as opposed to the state rules?

You have to live in New York for at least 2 years before you can use the New York or federal exemptions. Until then, you have to use the Florida exemptions.

(91 days is the amount of time you have to live in New York before you can file a Bankruptcy in New York.)
