Customer Question

I nede help I filled bankruptcy in 2010 Chapter 13 but has not been discharged since I am still paying on the amount agreed by the court. This will not be paid off for another two years. Repeat has not been discharged yet. I received a 1099C of 55,000.00 from the bank from a property i owned. This is considered as income. I believe I can do an 982 form to the government since it has not been not discharged yet.
On the 982 do I check 1a title 11 case or 1b discharge as insolvent. I jsut want ot make sure i am doing the correct thing as i dotn want the IRS coming after me for not doing the right thing.
Thank you
Chris

Yes - the instructions for form 982 - which are on the last page of form 982- say to check 1a if a Bankruptcy case is in progress (under the jurisdiction of the court).
