My stepson filed bankruptcy and he included the money he owes

Customer Question

My stepson filed bankruptcy and he included the money he owes me. I want to know if I can motion against him, And have the court to order him to make payments to me like the other debts.

Hi JACustomer,

1) Is this a Chapter 7 or a Chapter 13 Bankruptcy?

2) What is the money owed for?

Customer: replied 4 years ago.

Chapter 13

He owes me $10,000

Expert:  cfortunato replied 4 years ago.
If the $10,000 was for a loan, you have to receive payment from the Bankruptcy court, not from your stepson. There is no motion to file to receive money directly from your stepson.

I think this is what you wanted to know. If not, please let me know.
Thank you.
