If there is a current order for child support and spousal support

Resolved Question:

If there is a current order for child support and spousal support through a wage attachment and the paying party with the wage attachment files chapter 7 bankruptcy and lists the support in the bankruptcy, can that include the support order so that the paying party no longer has to pay even if the paying party is still employed and able to pay?

Hi JACustomer,
A Bankruptcy filing does not affect domestic support obligations and payments. Bankruptcy Stat. 523(a)(5).
If the debtor's wages were being garnished before a Bankruptcy was filed, they will continue to be garnished - in exactly the same manner - as before the Bankruptcy was filed.
