I am an attorney with 25+ years of legal experience and am working diligently on your answer while I await your response.

Please tell me:
Did you sign a reaffirmation agreement?
Was the modification included in that reaffirmation?
Did you file a 7 or 813 bankruptcy?

Customer: replied 5 years ago.
Yes the payment was in the affirmation i got from the mortgage attorney's office and i filed chapter 7

The terms of the reaffirmation agreement control. Typically the reaffirmation agreement would state the total amounts of principal outstanding, the interest rate and the payments due. If the terms of the reaffirmation agreement allow the payments to change according to an interest rate change or other rationale, the payments may change.
