What is the basis to claim fraud
Customer: replied 5 years ago.
Hi Kirk.

It's for non-payment because they could no longer withdraw the payment amount from
my checking account. This bill is from 2005. The checking account has long sinced closed. Hope this helps. thanks!
It's not fraud simply because you failed to pay the debt back. You could be sued for the money due, but it's not fraud.

Also, fraud only has a 2 year statute of limitation in Pa. Also, debts on an open account must be sued over within 2 years. Thus, it's highly probable that the creditor cannot collect because it's time is up to do so.
