If a prospective tenant has filed bankruptcy can they try to

Resolved Question:

If a prospective tenant has filed bankruptcy can they try to include a future lease (for example renting my property) in their bankruptcy?

Hi JACustomer,

Yes - if a tenant files a Bankruptcy, they can include a lease in the Bankruptcy. (Unexpired leases go on Schedule G). This would mean the Bankruptcy filer would no longer be responsible to pay the rent going forward, and any rent that is already owed. however, he or she could then be evicted if he or she did stop paying the rent.

I think this is what you wanted to know. If not, please let me know.

Thank you!
