On what date did you file the Bankruptcy?
I asked the for the date, not the state.
If the back taxes were listed in the Bankruptcy, the IRS cannot keep your refund for those taxes.
Additionally, if you filed in 2010, the Bankruptcy trustee is only entitled to the refund from tax year 2009, not the refund for tax year 2010 (the upcoming refund). This is because, with a few exceptions that do not apply for your case, the trustee is not entitled to anything the debtor gets after the Bankruptcy is filed.
