Customer Question

On October 14, 2005 my lawyer filed backruptcy in Colorado, Chapter 7. Since that time I divorced and moved to AZ. I am now engaged (will get married in CO). If my name is XXXXX XXXXX bank accounts,...of my husband's existing accounts, home, car, 401(k), ... can the courts come and take my son-to-be husband's money? If so, what can I do to protect him?

Hello,

A Chapter 7 bankruptcy filed in October, 2005 would typically have resulted in a discharge of your debts (erased) in January/February, 2006.

Provided you received your discharge on or about January/February, 2006, you can now acquire assets without concern of the bankruptcy court. This includes putting your name on your new husbands assets.
