After a chapter 7 bankruptcy is discharged and I recieve a Medical Mal practice settlement, do I get to keep settlement?

You will want to review your petition carefully. If your petition discloses the claim and if the trustee either closed the case as a "no asset" or "abandoned" the claim, you may be entitled to keep the settlement.


However, if the incident that gave rise to the settlement arose prior to the Chapter 7 filing, the settlement would typically be required to be turned over to the trustee in the bankruptcy.
