Customer Question

My ex-husband is filling ch 13 bankruptcy. He is currently caught up with his child support obligations. Do I need an attortney to protect me? Also, how will my child support be paid? Will he continue to pay personal or the bankruptcy court be handling my child support from now on?

Thank you for your question.

Bankruptcy does not affect or discharge child support obligations, so your ex will still be responsible for making timely child support payments.

Generally his bankruptcy should not affect you as long as there are you have no joint debt or debts in both of your names.
