What happens if the police fail to serve you and give you a brief of evidence by the date that the judge allocated in court? What happens if you don't receive it at all?

Good Morning.

If they have not given them to you, you cannot proceed to a hearing because you do not know what their evidence is you would be seeking a further adjournment for them to serve you. You can try and have the court make a costs order for the delay but that normally does not happy.

If they continue to delay you can later on seek the matter be struck out.
