I have attended Liverpool court this morning on an AVO order

This answer was rated:

I have attended Liverpool court this morning on an AVO order and in seeking legal advice yesterday was told to consent to the AVO without admissions.
JA: Since laws vary from place to place, what state is this in?
Customer: NSW
JA: Has anything been filed or reported?
Customer: Offence - Stalk/intimidate intend fear physical etc harm (domestic) T2 Section 13(1)
JA: Anything else you want the lawyer to know before I connect you?
Customer: yes i went to consent with the AVO without concessions and was told i couldnt and got an ajournment

Good Morning.

My name is ***** ***** I am a NSW Solicitor. Thank you for your question, and will do my best to assist you with your question. Please understand I am very limited on what I can tell you and that you may have to get more detailed advice.

What did the court say? Do you agree with the facts in the AVO?

Were you also charged with a criminal offence and what did you plea to that?

Customer: replied 1 month ago.
The Police register said i couldnt consent to the AVO without admissions and told me 2 get an ajournementi dont really agree with the facts and my wife is willing to try and get the order removed if she canno offence

Good Morning.

There is no oder unless they got it over the phone. You have been served with the papers.

Do you know if there is also a charge sheet? If there is a charge sheet this is more serious because they are charging you with a criminal offence and the AVO is in addition to that

Customer: replied 1 month ago.
no charge sheetjust 1a,b & c

Good Morning

ok

You need to go and see a solicitor that practices in criminal law.

The police will not withdraw it easily. Your wife is their witness and she is the one that has to go to court on the next occasion and thought the prosecutor convince the magistrate.

If you choose to accept it without admissions you will need a solicitor there so that the court is satisfied you understand the implications this has on you.

I would not be accepting it if the facts are incorrect. They need to be corrected and if they are false all together and you have not been violent then you should be pleading not guilty and running a hearing.

It will cost you money but your record is at stake here as any acceptance or finding that you have done these things will appear on your record.

I hope this makes sense and is of assistance. if there is nothing further
