My name is ***** ***** I am a NSW Solicitor. Thank you for your question, and will do my best to assist you with your question. Please understand this is not legal advise but a guide to assist you. Do you have the contract
Can you email it me to***@******.***
I will get back to you when I receive it.
are you the subcontractor?
The only thing I can find is that they can terminate if you default.
Has the contract work commenced?
Have you started the work? What is the issue?
The contract does not give you right to terminate only the other side can terminate because of your default and they an sue you for the default.
If they are wanting you to do work that is not part of the contract they are in breach but there is nothing in it to say what happens if that is a breach.
You do not have to do anything more than the contract says and you can argue that they are in breach. If you agree with the changes then you have agreed to the variation and you are stuck with it.
So you have to advise them that you are not making any changes and if they are not honouring the contract it is void.
I hope this makes sense and is of assistance. If there is nothing further
thank you for using my services.
