Have Australian Law Questions? Ask a Lawyer Now.
Hello and thank you for your question.
I'm sorry to have to say, but if you are the driver of a car you are the person responsible for driving the car, which means if you cause an accident you are responsible for any damage you cause, which may include damage to both cars.
If your son's friend was insured the provided he was driving with permission the friends insurance might have covered your son, but if there is no insurance, he will be liable for any accident he causes.
I appreciate that is not what you were hoping to here, but it does reflect the legal reality of his situation.
Good luck and please rate my answer.
