Customer Question

defacto partner walked out two weeks ago. we have three children aged 4 and a half, just over two and a nine month old baby. We had arranged access between 11 am and 4 pm today but he has demanded over night access to the children. I don't know where he will be taking the children

I am a solicitor here in Australia, Sydney actually.
Issue is, NO court will allow a 9 month old overnight with the father.
BUT he of course should have some meaningful regular contact.
I would suggest, having contact continue during the day, extended to 10 - 4, then when the youngest reaches 12 months and above, have all children spend time with him each alternate weekend, overnight.
I would also suggest going to relationships Australia to have a parenting plan organised.
