no, but in the process and have spoken to the ATO regarding them

God, have them lodged, ASAP, have some correspondence from the ATO confirming that it has been arranged at the very least.
Attend court, then enter a plea of guilty to the charges, with an explanation and confirm that you have now made amends.
If you have no prior criminal record, the court should not convict you in respect of same, giving you a Section 10 dismissal.

Yes, as it is a criminal offence.
It maybe an issue, you need to disclose it.
