I purchased and lived in paying rent a caravan and annex for over 4 1/2 years in August was told I had to pull 5 mtrs of the structure down because it was on council property,this is in a privately owned park, To comply with this I had to put my personal belongings into storage that are still there apply and pay for approval fees to certifier and council $975.00 being for an addition of a structure 5.2mtrsx2.4mtrs, at a further cost to me of $4,750.00 all the time paying rent of $164. plus elec. without any assistance from owners or management,My argument is should not the owner have known where park boundry ends and council boundry starts, And am I entitled to any retribution thanks Pat.
My storage fees for 3 months was $255.00 per month but now $143.70 per month and currently the park management is still accepting rent from vans and motor homes that they put on so called council owned land indicating to me liability.

Hi Leon,Yes that is correct,you don't buy a property and not know where the bounderies are especialy if your a shrewed business person like this person,owning several dwellings plus shopping complex,the part of my property I had to pull down was built professionaly by the previous owners befor my time and was bought by me in good faith,if the said construction encroached on council property the park owner should have notified the previous resident of the said council boundary and instructed him to dismount it or not build it as the park would be liable I feel that this person would plead ignorance that being his attitude.
Hi Leon,There was no contract,this was just a private sale with the approval of the caravan park owner as is the law here in QLD.My beef is with the caravan park owner as he is the one that allowed the construction and sherked his responsabilities as the owner towards allk residents and who is collecting rent for occupation of land he does not own,providing lack of maintainence high rent while all collected rent goes off shore.
There were a few of us caught in this scam, one bloke I do know said to the manager at the time who also happened to be the owners son,And was wanting to put on extensions, How do I go about approval, his reply was its all right just go ahead it all comes under the parks umbrella.
At the time,he was the manager also the owners son, an adult not a kid,in the case of my problem I believe he was on holidays in New Guinea also the home of the parent company at the time of construction on his return he looked at the site and walked off saying nothing,I was unaware of this until recently.

Hi yes it does make sense,but the problem would be getting everyone to stand together as one, We are all pensioners and have no where else to live and he would have no quarms in shutting down the park and kicking us all out in the street, as I say there are 54 permanent residents there, no money has been spent on improvements or safety, Its been the same for 20 years if you complain your given notice, and all your rent money goes straight to New Guinea to the coffee plantation.
No that's not how it works up here,IF YOU CANT SELL IT TO SOME ONE who the park manager agrees to then you have to have it removed at your expense.
Hi, yes pay your rent on time, NO NOISE AFTER 10PM and don't make any trouble keep your site clean and tidy, no subletting I think that about covers it.
